By installing, accessing, or using SecondFish ("the Extension"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Extension.

2. Description of Service

SecondFish is a browser extension that provides market analysis tools for online marketplace listings. The Extension offers:

• Market value estimates based on publicly available data
• Profit potential calculations
• Risk assessments and deal scoring
• Various analytical metrics to inform purchasing decisions

3. Nature of Information Provided

All information, analysis, estimates, and recommendations provided by SecondFish are for informational purposes only. The Extension:

• Does not constitute financial, investment, or professional advice
• Does not guarantee the accuracy, completeness, or reliability of any analysis
• Does not guarantee any specific outcome or profit from transactions
• Should not be relied upon as the sole basis for any purchasing decision

4. User Responsibilities

By using SecondFish, you agree to:

• Use the Extension in compliance with all applicable laws and regulations
• Provide and maintain your own valid API key from a supported provider
• Comply with the terms of service of OpenRouter and any other third-party services utilized
• Comply with the terms of service of Facebook Marketplace and any other platforms accessed
• Exercise independent judgment in all purchasing decisions
• Accept full responsibility for any transactions made based on Extension analysis

5. API Keys and Third-Party Services

SecondFish operates on a BYOK (Bring Your Own Key) model. You acknowledge and agree that:

• You are responsible for obtaining and maintaining valid API credentials
• You are responsible for all costs incurred through your API usage
• Your use of third-party AI providers is governed by their respective terms of service
• SecondFish is not responsible for the availability, performance, or policies of third-party services

6. Intellectual Property

SecondFish and all associated intellectual property, including but not limited to software, design, logos, and documentation, are owned by SecondFish Technologies LLC. You are granted a limited, non-exclusive, non-transferable license to use the Extension for personal, non-commercial purposes.

7. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SECONDFISH TECHNOLOGIES LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of any analysis
• Warranties that the Extension will be uninterrupted, error-free, or secure
• Warranties that defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECONDFISH TECHNOLOGIES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from your use of or inability to use the Extension
• Any damages arising from transactions made based on Extension analysis
• Any damages arising from unauthorized access to or alteration of your data

This limitation applies regardless of the legal theory upon which the claim is based, including negligence.

9. Indemnification

You agree to indemnify, defend, and hold harmless SecondFish Technologies LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Extension or violation of these Terms.

10. Modifications to Service

SecondFish Technologies LLC reserves the right to modify, suspend, or discontinue the Extension at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Extension.

11. Changes to Terms

We reserve the right to update these Terms of Use at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Extension following any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and SecondFish Technologies LLC regarding the use of the Extension.
